Pin Si Kitchen Pte Ltd (“We, “Us”, “Our”) sets out these terms and conditions (T&Cs) for each customer (“You”, “Your”) to adhere and comply at all times while using this site featuring our products and services to you when you visit or use https://www.pinsi.com.sg.

Acceptance of T&Cs

Please read these T&Cs carefully.  By using this site, you agree to these T&Cs, and you consent to the collection, use, and disclosure of your personal data as described in these T&Cs. If you do not agree to these T&Cs, you must discontinue using this site. Your use of this site shall be deemed to be your consensus to be bound by the T&Cs set forth below. Pin Si Kitchen Pte Ltd can change these T&Cs at any time by posting updated T&Cs on this site. If any modification is unacceptable to you, you shall cease using this site immediately.

It is your responsibility to check these T&Cs from time to time to take notice of any changes we have made as they are binding on you.

Data Policy

We collect personal data such as your name, contact information (e.g. mobile number and email address) and other information that may identify you or is personal to you, when you use this site or enter into transactions with us (or express interest in doing so). We may also collect information about your browser type, device ID, IP address and the pages you visit.  

By your continued use of this site, you agree that we may collect, use, disclose and process your personal data in accordance with the Personal Data Protection Act 2012.

The Purposes may continue to apply even in situations where your relationship with us has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you). 

The consent that you provide for the collection, use, disclosure and processing of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using, disclosing and/or processing your personal data for any or all of the Purposes by submitting your request in writing to sales@pinsi.com.sg.

Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within 10 business days of receiving it.  

Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing this site to you and we will, in such circumstances, notify you before completing the processing of your request. 

If you have any feedback or issues in relation to your personal data, or about our Privacy Notice, or wish to make a complaint to us, you may contact our Data Protection Officer whose email address is set out in the Privacy Notice. 

We may update the Privacy Notice from time to time without notice to you, to comply with applicable laws or as we update our data usage and handling processes. The amended Privacy Notice will take effect when made available and without prior notice to you. Your continued use of this site constitutes your acknowledgment and acceptance of such changes.

You acknowledge that this site contains information, data, software, photographs, graphics, typefaces, music, sounds and other material (collectively, “Content”) that are protected by copyrights, trademarks, database and other intellectual property rights owned by us and/or our affiliates, business partners, or suppliers. Any reproduction of the website, whether in whole or in part, is strictly prohibited without prior agreement.

Availability of Website

Whilst all attempts will be made to ensure this site’s accessibility is available at all time, occasionally it may undergo repairs, maintenance, or the introduction of new services. In such circumstances, access to this site may be suspended temporarily and without notice. We disclaim any liability for any malfunction, suspension or interruption of this site, including accessibility due to network problems.

Pricing and Product Information

Whilst every effort is made to fulfil orders in terms of price, size, weight, colour and/or description through this site, errors may occur and we do not guarantee that the pricing, size, weight, colour, product description and/or promotional information provided on this site will be accurate, current, updated, or complete. Without limiting the generality of the foregoing, you acknowledge and agree that: 

• product pictures on this site are provided to help you recognise the products, but due to packaging redesign and improvements, these may not reflect exactly the product you receive; 

• not all products will correspond exactly to the photographs and description on this site;

• where product pictures are not available, a generic image may be used;   

• we take good care to accurately display the colours of our products that appear on FPG Services. However, as the actual colours you see will depend on your monitor (among other factors), we cannot guarantee that your monitor’s display of any colour will be a true reflection of the actual colours of the products. 

In the event of any price difference between your web’s order and the final bill rendered, whether arising from substitutions, daily price changes, out-of-stock products, promotions, mislabelling, mispricing, we reserve the right to adjust the final bill even after an online bill has been presented to you. 

We shall not be liable to any person for any loss, damage, or inconvenience in the event that we are unable to fulfil any order for whatever reason.

Product Unavailability

We reserve the right to change the product range at any time and from time to time. Certain offers may have a restricted period of validity that will be indicated for each product or product range. We undertake to honour orders received on the website only within the limits of available stocks. In rare cases, a product that is shown as available on this site may become unavailable after definite registration of the order. In the event that one or several products ordered become(s) unavailable within the time period indicated, we undertake to inform the customer as quickly as possible by email or whatsapp messaging. The order shall be automatically cancelled and the customer is reimbursed within 30 days at the latest following full settlement of the amount paid, except where the customer expressly wishes to switch your order to a substitute product.  The customer agrees and acknowledges that no penalty shall be applied for such cancellations and that subject to the above, receipt of reimbursement of the amount paid by the customer shall be conclusive, and the customer waives all rights to claim any penalty or other costs from us.

Special offers are valid only while stocks last. We reserve the right to reject and/or limit quantities on any order received.

Acceptance & Confirmation of Order

The customer may place an order on the website. The process for placing an order is as follows:

• Select your products and add them to your shopping cart

• Validate the contents and quantity of products of your cart

• Key in your personal details

• Indicate pick up/delivery date 

• Indicate specific remarks (if necessary)

• Select preferred mode of payment

• Confirm your order

• Validate payment

You are able to see the different stages of the order details and the total price and may correct any errors before confirming your order, thereby expressing your acceptance. Payment for the price of the products makes the order final and no amendment of the order may be entertained by or taken into consideration by us thereafter. Conclusion of the contract is only effective after confirmation of the order by us. We confirm the order by sending an email to the email address provided by you.  We reserve the right to cancel or refuse to accept any order from a customer whom there is a dispute concerning payment of a previous order or who, in our opinion, presents any form of risk. Any information given by you remains your sole responsibility and any anomalies generated by you may not be borne by us nor shall we be liable for any loss or damage occasioned thereby, in the event that it becomes impossible to carry out the order and achieve a successful outcome.

 

Exchange Policy: Refunds/Cancellations

We accept no refunds, exchange, cancellations or amendments is applicable once payment is processed and completed online.

Delivery

We will provide delivery service in mainland Singapore on any orders placed through this site. For the avoidance of doubt, we do not deliver to Jurong Island and any other islands.

Where customer requests us to leave the product(s) at the front door or anywhere outside the delivery address, such delivery shall be at the Customer’s sole risk and the Customer accepts all liability and risk of loss, theft and damage.  

We shall not be liable for any consequential, indirect, or damage or loss, however arising, or any deterioration or change in quality or condition of the order after its delivery. We and its delivery service provider may decline requests to deliver/leave the order at a place other than the front door of the delivery address.  

Whilst we strive to complete delivery of your order expeditiously, delivery of your order may be temporarily unavailable or delayed in the event of bad weather or any unforeseen circumstances. All delivery times stated, agreed or represented by us are meant as indicative estimates only, and we shall not be bound by or liable for any inconvenience or loss occasioned to you from late deliveries.

Our delivery service is subject to the availability of our resources and we reserve the right to cancel or reject any delivery request at our sole discretion.

We may use third party delivery service providers to perform delivery of your order. We shall not be liable or responsible for any inconvenience or loss occasioned to you from any late deliveries or mishandling of the order, which is attributable to the third party delivery service provider. 

Should a delay of delivery date and time be required (upon Customer’s request), the order will be subjected to a surcharge of S$12.00 (incl. of GST). 

For provision of our online home delivery services, we reserve the right to charge you the following fees, including but not limited to:

• Service Fee: to partially cover the costs of processing, picking and packing

  • Delivery Surcharge: applicable fees based on higher cost for high demand delivery slot

• You will be notified of any applicable fees 

In the event that you are not present to receive an order at the scheduled delivery date, there will be a redelivery charge of S$8.00, payable in cash to the driver. You are required to provide a redelivery date within 2 days from the original scheduled delivery date, failing which, we will proceed to cancel the order with cancellation fee and transportation charge applies. The balance order amount will be refunded through the same mode of payment.

Payment (Secured Transactions)

Online payment is made exclusively by payment gateway “HITPAY” and “STRIPE”.  You accept that your account is debited for the total amount due at the time of the order. Depending on the type of card, you enter your card number, its expiry date and security code (composed of the three figures shown on the back of the bank card), then validates this data, or has the possibility of returning to the previous page. After payment has been validated by the banking organisation, the order is accepted by us who confirms acceptance of the order to you by email or whatsapp messaging. You undertake to personally use the bank card of which you are the registered holder. In the event of fraudulent use, we cannot be held liable. In the absence of payment by the bank, or a refusal by the banking centre to make payment, the order shall be automatically cancelled and you will be informed by email or whatsapp messaging. The products remain the property of ours until it receives full payment of the price.

Limitation of Liability

You acknowledge and agree that you assume all risk in connection with the use of this site. We shall not be liable for any direct, indirect, consequential, punitive, loss of profits or revenue, or any other damages or loss however arising from your use of and access to this site.  

To the extent that we are liable in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of a product or any other breach of our obligations hereunder, such liability shall not in any event exceed an amount equivalent to the price of the product(s) giving rise to such liability. 

Both Pin Si Kitchen Pte Ltd and the delivery service provider will not be held responsible for any damage or loss after delivery. You shall not use our products in any manner and/or for any purpose for which they are unsuited for and you shall be responsible for using all necessary care in handling and using the products. You expressly agree that we assume no obligation or liability for any advice or information given with the products and we assume no responsibility for any inaccuracy or misstatement of any such information. You assume all risks connected with the use and storage of the products. 

All information contained in this site are provided on a “as is” basis without any implied or express warranty including any implied warranty as to title, quality, merchantability, fitness for purpose, or non-infringement. Before acting on the information found on this site, you may wish to confirm the facts that are important to your decision making. We reserve the right to change or update information about any product at any time without prior notice.

Representations or descriptions displayed on this site are not intended to advice on which reliance should be placed. Hence, we disclaim all responsibility and/or liability for any reliance placed on such material by any user of this site, or by anyone who may be informed of its contents.  

To the fullest extent permitted by law, we shall not be liable for any error or omission in the content of this site including any damage or injury arising out of or in connection with any access or use of this site whether such damage/injury is caused by failure of performance, error, omission, defect, delay in operation, computer virus, theft, etc. 

We shall not be liable to any Customer or persons for any loss, damage incurred or inconvenience suffered in the event we refuse to fulfil an order or cancels or withdraws any order for whatever reason including but not limited to an unforeseen circumstance (e.g. lack of availability, quantity, etc.).

Third Party Sites

There may be occasions where materials on or of third parties are provided on this site. We are not responsible for the content and activities of any third party site linked from and/or outside this site. Your visit or use of any third party site linked from this site is entirely at your own risk. A link to another website does not mean that we accept any responsibility for the content displayed on the other website.

 

Prohibition of Sales Beyond the Network

The products are intended to be sold exclusively through our distribution networks. It is therefore strictly prohibited to buy products for resale purposes outside of our networks, in particular, through online platforms. Over and above an infringement of our brands and the integrity of our products, such acts may involve the legal and criminal liability of their perpetrators, where appropriate.

 

Applicable Law & Disputes

The T&Cs, and any disputes arising from or under these T&Cs, shall be governed by Singapore law. Either party may submit a request to mediate to CASE upon which the other party will be bound to participate in the mediation within CASE prescribed time. If the Dispute cannot be resolved at mediation, such Dispute shall be referred to the Small Claims Tribunal or the courts of Singapore, as the case may be, for resolution.
